These terms apply to your use of nousia.com.au (the “site”) and to any application, enquiry or booking you make through it. By using the site you agree to these terms. If you do not agree, please do not use the site.
Training programs, employer engagements and employment with NOUSIA are covered by separate written agreements, which prevail over these terms if there is any inconsistency.
1. About us
The site is operated by NOUSIA (“NOUSIA”, “we”, “us”, “our”), based in Melbourne, Victoria. Contact us at contact@nousia.com.au.
2. Using the site
You may use the site for lawful purposes only. You must not:
- interfere with the site’s security or operation, or try to access data that isn’t yours;
- submit false or misleading information, or apply on someone else’s behalf without their authority;
- upload malicious code or content that is unlawful, offensive or infringes anyone’s rights;
- scrape, copy or harvest content or data from the site by automated means; or
- use the site in a way that breaches any law.
We may suspend or restrict access to the site if we reasonably believe these terms have been breached.
3. Applications, enquiries and bookings
Information you give us must be accurate, complete and your own. Submitting an application does not guarantee a place in a program, a particular training outcome, a security clearance or a job. Eligibility for some programs and roles depends on citizenship, background checks or employer requirements. Bookings are subject to availability and may be rescheduled.
4. Program information
We aim to keep program details, roles, timelines, salary ranges and statistics on the site accurate and up to date, but they are general information only and may change. Salary figures are indicative and drawn from published sources. Nothing on the site is professional, financial or career advice for your particular circumstances.
5. Intellectual property
The site and its content, including text, design, graphics, software and the NOUSIA name and logo, are owned by or licensed to NOUSIA and protected by law. You may view and share pages for personal or internal business use. You must not copy, modify, republish or commercially use them without our written permission.
6. Content you submit
You keep ownership of content you submit, such as a CV or work samples. You give NOUSIA a non-exclusive licence to use it to assess and respond to your application or enquiry and to provide our services. You confirm you have the right to submit it.
7. Third-party links and services
The site may link to third-party websites or use third-party services, such as scheduling tools. We do not control them and are not responsible for their content, availability or privacy practices.
8. Australian Consumer Law
Our services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms excludes, restricts or modifies any right or remedy you have under the Competition and Consumer Act 2010 (Cth) or any other law that cannot be excluded.
9. Limitation of liability
To the extent permitted by law, the site is provided “as is”, and NOUSIA is not liable for any indirect, special or consequential loss, or loss of data, profit or opportunity, arising from your use of the site. Where our liability cannot be excluded but can be limited, it is limited, at our option, to resupplying the relevant service or paying the cost of having it resupplied.
10. Indemnity
You agree to indemnify NOUSIA against claims, losses and costs arising from your breach of these terms or your misuse of the site, except to the extent caused by our own negligence or breach.
11. Privacy
Our Privacy Policy explains how we handle personal information. It forms part of these terms.
12. Governing law
These terms are governed by the laws of Victoria, Australia. You and NOUSIA submit to the non-exclusive jurisdiction of the courts of Victoria and the Commonwealth of Australia.
13. Changes to these terms
We may update these terms from time to time. The current version will always be on this page, with the date it was last updated. Continuing to use the site after a change means you accept the updated terms.
